Business Interruption insurance coverage may be state-mandated for COVID-19 losses

April 8, 2020 – Interesting article in today’s Washington Post regarding #businessinterruption #insurancecoverage. With the ongoing #coronavirus #pandemic, many businesses who purchased business interruption insurance may not be covered due to #exclusions added by insurers following the 2002-03 SARS outbreak. Businesses should review their insurance to determine whether their policies include such exclusions. Even if there is a virus/pandemic exclusion, the policy may include civil authority provisions that provide coverage in the event of a governmental order that prevents access to the business. Another important provision/consideration is the state law that governs the policy. Finally, businesses should also be monitoring state legislative actions in the coming days in the states where they are located. New Jersey, Massachusetts, and Ohio are currently considering forcing retroactive policy changes to cover #coronavirus business interruption claims. A link to the article is below.
